A BILL to amend and reenact section one, article five, chapter
sixty-one of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to the crime of
perjury; creating a felony offense of perjury for a witness
to wilfully testify before a grand jury considering a felony
presentment.
Be it enacted by the Legislature of West Virginia:
That section one, article five, chapter sixty-one of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 5. CRIMES AGAINST PUBLIC JUSTICE.
§61-5-1. Perjury and subordination of perjury defined.
To wilfully testify falsely, under an oath or affirmation
lawfully administered, in a trial of the witness or any other
person for a felony or as a witness before a properly convened
grand jury considering a felony presentment pursuant to the
provisions of article two, chapter fifty-two of this code, concerning a material matter or thing, is perjury and is a
felony; to induce or procure another person so to do is
subordination of perjury and is a felony.
NOTE: This bill creates the crime of perjury; creating a
felony offense of perjury for a witness to wilfully testify
falsely before a grand jury considering a felony presentment.
